Legally, fasting is abstaining from the desires of the stomach and the private parts (things that invalidate the fast) from dawn until sunset. All of these are permissible at night, as Allah Almighty says: "So now have sexual relations with them and seek what Allah has ordained for you, and eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]. Then complete the fast until the night."

Accordingly, marital intimacy is permissible at night during Ramadan. However, during the day, it is not permissible except with a legitimate dispensation, such as illness or travel. Whoever has intercourse during the day without an excuse commits a great sin, and both must make up for the missed fast. The husband must offer expiation without dispute, while scholars differ on whether it is obligatory for the wife.
