Is it permissible to take the blood money (diyah) of the deceased from insurance and dispose of it through charity or for the heirs to take it?

If a brother insures a car, it is not permissible to take more than the amount of insurance premiums he paid. The remaining amount must be given in charity because commercial insurance contracts involve gambling (maysir) and uncertainty (gharar), which are not permissible in Islamic law.
