The sons of the brother inherit from their paternal uncle by ta'sib (agnatic succession) if he has no son, father, or inheriting grandfather, or full brother, or paternal half-brother. They take the remainder after the legal sharers (ashab al-furud). As for the house that the deceased wrote over to his daughters, it becomes their property under two conditions: that he wrote it over to them while in good health, not during his death illness, and that they took possession of it and managed it as owners during his lifetime. Otherwise, the gift (hibah) is not valid and is considered a bequest to an heir, which is not enforceable unless approved by the other heirs.
