Why did the Messenger of Allah, may Allah's peace and blessings be upon him, not impose the death penalty for apostasy on the hypocrites who slandered the religion, and why did he not treat them as spies despite their contacts with enemies?

Hypocrisy is the outward display of faith while concealing disbelief. The fundamental principle in Islam is to accept what a person outwardly manifests and to entrust their inner state to God, based on the Prophet Muhammad's (peace be upon him) saying: "I have not been commanded to probe into the hearts of people or to rip open their bellies."

Even though the hypocrites revealed their disbelief through words and actions, the Prophet (peace be upon him) did not punish them. Scholars differed on the reason for this:

1. First view: The repentance of a hypocrite is accepted if they declare it after their hypocrisy becomes apparent. This is the view held by Ash-Shafi'i, who argued that displaying faith protects one from being killed.

2. Second view: A hypocrite is not asked to repent but is instead executed. They explained the Prophet's (peace be upon him) lack of punishment for the hypocrites with one of two reasons: First: The absence of clear legal proof (confession or witnesses) to establish the prescribed punishment, as the Prophet (peace be upon him) did not rule based on his personal knowledge. Second: To prevent greater evils and to win over hearts. The Prophet (peace be upon him) feared that people would say he was killing his companions, which would alienate people from Islam, especially since Islam was in its early stages.

In conclusion, the failure to impose the prescribed punishment on the hypocrites was either due to the lack of legally sound proof of their disbelief, or to avoid discord and alienating people from Islam.
