If the wife returns to you before the expiration of her 'iddah (waiting period), it is recommended to mediate for reconciliation between you. If reconciliation is not possible, then the divorce should be done kindly. It is also recommended to agree to her request for khul' (divorce at the wife's instance) if the marital relationship is poor.

If the wife does not return to you before giving birth to her child, she has become irrevocably divorced from you. She is entitled to the rights of a divorced woman and has a greater right to custody of her child, unless she remarries or there is an impediment to her custody. The child's maintenance is obligatory upon you.

Regarding visiting the child in custody, the custodian is not allowed to prevent the child's family from visiting. The visitation should be according to what is customary. There is no harm in the court specifying three hours per week for visitation as long as the child is below the age of discernment.

Once the child reaches the age of discernment, he should not be prevented from visiting you so that you may undertake his upbringing. Your refusal to see your child until he reaches fifteen years of age is impermissible, as it involves severing kinship ties and neglecting the child's right to upbringing and discipline.
