What is the share of the heirs of a deceased woman who has two full sisters and two daughters of two deceased full sisters?
For the two sisters, two-thirds of the inheritance, based on the Almighty's saying: "But if there are two, they shall have two-thirds of what he left." The remainder goes to the nearest male 'asaba (agnate). The daughters of sisters are considered Dhawee al-Arham (relatives by blood but not entitled to a fixed share), and they do not inherit in the presence of Ashab al-Furood (those with fixed shares) and 'Asabat (agnates). If the deceased has no 'asaba, then the remainder after the sisters' fixed share is returned to them by way of radd (return). It is recommended for the heirs to give the daughters of the sisters something from the inheritance, based on the Almighty's saying: "And when [other] relatives and orphans and the needy are present at the time of division, then provide for them [something] out of it and speak to them words of appropriate kindness." The matter of inheritances must be referred to the courts for investigation into the heirs, wills, and debts.
