If a person acquires unlawful wealth and takes only what suffices his needs, then wishes to pay zakat and gives it to a young man who possesses the nisab, but this money is insufficient to cover his needs for more than a few months because it is consumed, is this money considered lawful for this young man, or must it be destroyed? And is the compelled person who received this zakat sinful, or is the one who paid it sinful?

Whoever acquires unlawful wealth must dispose of it by returning it to its owner or their heirs. If the owner is unknown, it should be spent on general Muslim welfare, such as for the poor and needy, or for mosques and bridges. This should be handled by a just judge or a righteous person. If that is not possible, the person who acquired it should spend it themselves. A poor person who possesses unlawful wealth may take from it what suffices for their needs and the needs of their dependents. This is not considered zakat but rather a disposal of unlawful wealth. Zakat is not obligatory on this wealth if the amount taken for need is less than the nisab at the end of the year, unless it reaches the nisab, in which case zakat becomes obligatory. It is permissible to give a needy person for marriage from zakat what suffices for their marriage.
