Would the son be sinful if he were to evict his father from the apartment that the son prepared for his parents and in which the father resided?

The majority of scholars hold that it is not permissible for a father to take possession of his son's wealth without his permission if the father is self-sufficient, and the son has the right to demand his debt from his father.

The Hanbalis, however, are of the view that a father may take possession of his son's wealth without permission, provided that it does not harm the son, and that the son does not have the right to demand his debt from his father. The opinion of the majority is more preponderant.

Therefore, if the apartment is owned by the son, he has the right to demand that his father vacate it and hand it over to him. If the father refuses, the son may refer the matter to the judiciary without being considered disobedient.

However, it is better for the son to leave the apartment for his father, if he can do without it, as an act of kindness. If he is in need of it, then he should politely ask him to vacate, or through the mediation of others.

In all cases, the son must honor his father and be good to him, for the father's right is great, and honoring him is among the greatest acts of closeness to Allah.
