What is the ruling regarding a husband having intercourse with his wife during the daytime in Ramadan on three separate days in two different years, and what are the consequences of that in terms of making up the fast (qada') or offering expiation (kaffarah) for both the husband and the wife, knowing that the husband is a diabetic?

Intentionally breaking the fast during Ramadan by engaging in sexual intercourse is a grave sin and a violation of the sanctity of the month. Both spouses must repent to Allah for spoiling the fast with intercourse, as it is one of the major sins. They must make up for the days on which they intentionally broke the fast through sexual intercourse. The husband must offer the greater expiation (kaffarah kubra), which is freeing a slave. If he cannot find one, then he must fast for two consecutive months. If he is unable to do so, then he must feed sixty poor people for each day on which intercourse occurred. If fasting affects the husband's health due to diabetes, he must make up for the days he missed if he is able to fast. As for the wife, she must repent and make up for the days she missed due to intercourse, but she is not required to offer expiation.
