Is it permissible for a working wife, whose husband takes her entire salary, to take some money without his knowledge to give to her needy family, especially since she feels wronged by her inability to dispose of her own money?
It is not permissible for a wife to take anything from her husband's money except with his permission, unless he withholds the obligatory maintenance, in which case she may take what is sufficient for her and her children in a reasonable manner. A wife's salary is her own property, and she is not obliged to give any of it to her husband or to share in household expenses unless it was stipulated by him or customary practice dictates it. If the husband did not stipulate taking anything from her salary in return for his permission for her to work, then he is not permitted to do so except with her full consent. If he takes it without her consent, she is permitted to take her right from his money without his knowledge, which is known as "Al-Dhafr" or "Al-Intisaf" (taking one's right by force or retaliation).
A condition for "Al-Dhafr" is that the wronged person does not exceed the extent of their right. The proof for this is Allah's saying: "Then punish with an equivalent of that with which you were punished" (2:194) and "So transgress against him in the same manner as he transgressed against you" (2:194). This opinion is the most preferred by a group of scholars, and it is the sounder of the two opinions and the one most consistent with the apparent meanings of the texts. As for the hadith: "Return the trust to the one who entrusted it to you, and do not betray the one who betrayed you," it is not strong enough to be used as evidence, because whoever takes only their due right without exceeding it has not betrayed the one who betrayed them. Spouses should live together in kindness and relinquish some rights to sustain the relationship.
