Will your wife be divorced, and will you be obligated to offer expiation or fast, if you said to her in a moment of anger: "You will be divorced if your foot crosses the apartment door," and then she opened the door and descended a few steps of the staircase without passing the apartment below?

The fatwa we follow states that a conditional divorce takes effect upon the fulfillment of the condition, whether the intention behind it was to effect a divorce, to threaten, or to emphasize. This is the view of the majority of scholars. Sheikh Al-Islam Ibn Taymiyyah, however, differed, holding that a conditional divorce intended as a threat or emphasis does not take effect, and in such a case, an expiation for breaking an oath is due. Accordingly, if the wife leaves the apartment, her divorce takes effect. However, if she believed she was prohibited from leaving the house's main door and only exited the apartment without leaving the house, the preponderant view is that neither divorce nor expiation is due.
