Is it permissible for a woman whose marital status is "suspended" and who is undergoing divorce proceedings to perform Hajj while in her waiting period (iddah)? And is it permissible for her to go to Hajj with her brother without her husband's permission if the time for Hajj arrives while she is still legally married to him?

Your departure for Hajj depends on two situations:

1. The court has not yet ruled on the divorce: You are still a wife. Obligatory Hajj: You may depart without your husband's permission, provided you are accompanied by a mahram (definition), prioritizing the right of Allah. Voluntary Hajj: Your husband's permission is required.

2. The court has ruled on the divorce and the procedures are ongoing: You may not depart for Hajj because you are in the waiting period (iddah (definition)), and you must remain in your home unless absolutely necessary. Exception: Imam Ahmad holds the view that a woman irrevocably divorced may depart for Hajj.
