Is it permissible to complain to the seller when a purchased item is damaged, and is it lawful to keep the damaged item that the seller does not request to be returned?
It is permissible to sell a commodity with a precise description. The buyer has the option to return the commodity or keep it without compensation if it turns out to be contrary to the description. If the commodity is defective, the buyer has the option to return it and receive a full refund, or to keep it and receive compensation for the defect (arsh), even if returning it is not impossible and whether the seller approves or disapproves. The buyer has the right to complain to the seller if there is damage or a defect in the commodity to recover his money or obtain compensation. If the seller does not demand the commodity after the price has been refunded, the buyer may benefit from it.
