Does a divorce take effect when uttered based on imagination or an intention conditioned upon the occurrence of a future event? What is the ruling on saying "You are divorced from me" without prior intention? Is it permissible to compel the wife to follow up with a female doctor instead of a male doctor?
If you pronounced the divorce willingly and consciously aware of what you were saying, then her divorce has occurred. And if you had conjugal relations with her before the expiration of her waiting period (iddah), then she has returned to your marital bond. However, if you pronounced it while overcome by obsessive thoughts that clouded your mind, then your divorce is not effective. And regarding your oath of divorce to your wife, if you were truthful in it, then no divorce has occurred thereby, and any doubt thereafter is not considered. It is not permissible for your wife to pursue pregnancy follow-up with a male doctor except out of necessity. And you must fear Allah, treat your wife well, avoid swearing by divorce, and beware of obsessive thoughts.
