Public auction is permissible under two conditions: that no harm is intended to anyone, and that the bidder genuinely intends to buy. Otherwise, it would constitute the forbidden practice of najsh (deceptive bidding). This differs from buying over one's brother's purchase or bidding over one's brother's bid. Jurists have unanimously excluded auction sales from this prohibition, citing the Hadith of Anas ibn Malik (may Allah be pleased with him) in which the Prophet (peace be upon him) sold a mat and a bowl by auction, and because Muslims have continuously engaged in auction sales in their marketplaces.
