What are the limits of a woman's waiver of her rights—as called for in verse 128 of Surat An-Nisa—in order to preserve her home and children? The noble verse (And if a woman fears from her husband desertion or evasion, there is no sin upon them if they make terms of settlement between them – and settlement is best. And souls are made to present avarice) permits reconciliation between spouses when the wife fears her husband's aversion due to old age or ill character. She can waive some of her rights (like maintenance or overnight stay) or offer money to her husband to remain his wife, as happened with Sawdah bint Zam'ah, may Allah be pleased with her. This reconciliation is permissible, and whatever conditions they agree upon are lawful. This does not diminish the status of the woman; rather, it is justice for her, with her choice and consent. The verse shows that avarice is inherent in the human soul, whether from the woman regarding her rights or from the man regarding his inclination towards a young woman.
