Is it permissible for a father to dispossess his son of money he gave him to invest, after a prior agreement, especially since the son is in dire need of the money?
Scholars have differed on the authenticity of the hadith "You and your wealth belong to your father," but the totality of its narrations strengthens it. It is permissible for a father to take from his son's wealth under certain conditions, among them that he does not take what the son needs. Scholars have differed on whether it is a condition that the father be in need; Imam Ahmad held that it is not a condition, while the three Imams (Abu Hanifa, Malik, and Al-Shafi'i) held that it is a condition, citing the hadith of Aisha: "They and their wealth are for you if you are in need of them." If the father takes the wealth by way of partnership, he must adhere to the agreement. It is advisable to try to reach an understanding and reconciliation with the father, while being extremely careful not to fall into disobedience to parents.
