After debts are paid and bequests are fulfilled, the deceased's estate is to be divided. Her full sister receives one half as a prescribed share (فرضًا), based on Allah's saying: "then for her is half of what he leaves" [4:12]. The brother's son receives the remainder by way of 'asaba (تعصيبًا), based on the Prophet's (peace be upon him) saying: "Give the prescribed shares to those entitled to them, and whatever remains is for the closest male." The daughters of full brothers are not among the heirs. What remains after the sister's share is taken by the males among the brother's sons or brothers of equal degree. Due to the seriousness and complexity of inheritance matters, it is preferable to consult Sharia courts or scholars to confirm the enumeration of heirs and to ensure there are no other bequests or debts.
