What is the expiation for intentionally killing a young man in a psychiatric hospital, and can 'Umrah be performed on behalf of the deceased?
The verses and hadiths indicate the gravity of intentionally killing a believer. If the killing was intentional, repentance alone is not sufficient. Rather, the killer must be handed over to the victim's guardians for retribution (qisas), or for pardon, or for them to demand blood money (diyah). Nevertheless, expiation () is obligatory, which is the freeing of a believing slave. If one cannot find a slave, then it is fasting for two consecutive months.
However, if the killer was insane at the time of the incident, there is no sin upon him according to the : "The pen has been lifted from three." But his 'aqilah (male relatives on the father's side) are liable for the man's blood money, and he must pay the expiation from his own wealth. If he does not possess wealth or cannot find a slave, then he must fast for two consecutive months.
In all cases, one must seek absolution from this injustice before the Day of Resurrection.
