What is the ruling on a man having sexual intercourse with his wife who has left the home for 4 years, without a divorce having occurred, and her refusal to return except on conditions that do not please Allah or the husband, and is he sinful for doing so?

Marital life is sustained by understanding, overlooking minor faults, and each spouse fulfilling their duties towards the other.

We advise the husband to fear Allah concerning his family and to be gentle in his dealings with them. If his wife is disobedient (nashiz), he should address her disobedience in the manner commanded by Allah.

We advise the wife to obey her husband in what is right, to be patient, and to avoid everything that angers or annoys her husband.

As long as the wife has not been divorced, she is a wife, and the husband may enjoy her as he pleases.
