It is legally forbidden to enter into a usurious loan contract, due to its involvement in aiding usury. The Messenger of Allah, peace and blessings be upon him, cursed the one who consumes usury, the one who feeds it, its scribe, and its two witnesses. All those involved in usury are committing a grave sin. As for the part deducted from an employee's salary: if the contract stipulated that the employer has the right to deduct this part, then it is not part of the wage to begin with, and the employee is not entitled to it. However, if the employer has unlawfully seized the employee's wage after the contract and deducted from it without the employee's consent, then the employee has the right to reclaim that. But this does not permit him to enter into a usurious loan, because he would still be aiding in the consumption of usury.
