The question

What is the ruling on marrying a woman infected with Human Immunodeficiency Virus (HIV) if her viral load is very low and undetectable, knowing that she was previously married and has a child who was not infected? Is it permissible for her to marry if her relations are protected, or if both parties agree not to engage in sexual intercourse, or if the man wishes to fulfill her marital rights to please Allah?

The answer

It is permissible for a person afflicted with AIDS to marry a healthy person or another afflicted person, provided that they inform the other party of their illness. If the other party agrees, then the marriage is permissible. A condom can be used during intercourse, with the necessity of fully informing the other party about the nature of the illness and its implications. Marriage can also occur without intercourse, as marriage is not limited to sexual relations but also encompasses care, companionship, and mutual support in obedience [to God]. The majority of scholars have agreed on the validity of the marriage of a person suffering from a death-bed illness.
