What is the limit of capability (istita'ah) in the ruling on expiation for sexual intercourse during Ramadan, and are there specific conditions for moving from one expiation option to another?
The order of expiation for intercourse during a day is the opinion of the majority of scholars.
Ability to free a slave means having the slave or the money to purchase one. If not found, one moves to fasting, based on Allah's saying: "But whoever finds none."
Inability to fast is due to illness or extreme hardship, based on Allah's saying: "And He has not placed upon you in religion any difficulty" and "Allah intends for you ease."
Included in inability is intense sexual desire, where it is permissible to move from fasting to feeding [the poor] to avoid falling into the prohibited act again, unlike ordinary hardship which does not permit moving to feeding.
