Is the beneficiary authorized by a company employee during his lifetime entitled to all his dues from the company, whether he is a Muslim or a non-Muslim?
The determination of an employee's entitlements is based on their authorization to the beneficiary. If the employee authorized the beneficiary to collect all their entitlements, the beneficiary takes all of them. If the authorization was for a part of them, the beneficiary takes the authorized amount. The religion of the authorizer, whether Muslim or non-Muslim, does not affect this as long as the employee is alive. After the employee's death, their entitlements become part of the inheritance and are paid to the heirs. If the authorization was an agency (wakala), it becomes void upon death. If it was a gift (hiba), it becomes void due to non-possession before the death of the giver. However, if it was a bequest (wasiyya) to a non-heir beneficiary, it is valid within the limits of one-third (of the estate). A bequest from a Muslim to a non-Muslim is valid.
