Is it permissible for a married woman with two children, living in France in a house purchased through the bank, whose husband has been unemployed for seven years despite having high qualifications, to take from the zakat money sent by her father? And what should she do with the money she neither gave to her husband nor donated as charity?

Scholars differed regarding giving zakat (definition) to one who is able to earn a living. The Hanafis and Malikis permitted it, while the Shafi'is and Hanbalis did not permit it, and this is the relied-upon opinion (mufta bihi).

If the husband is able to earn a living, it is not permissible for him to receive zakat. If he insists on idleness, the father should be informed of the scholars' differing opinions on discharging his obligation by giving zakat to him, so that he may decide whether to proceed with the zakat based on the view of the Hanafis and Malikis, or to reclaim it and give it to another deserving recipient.
