If the endower stipulated at the time of the endowment contract, or intended, that he would benefit from the well's water for himself and for the mosque, then he is permitted to use it for personal benefit. This is the sound opinion of the scholars. If he did not stipulate this at the time of the endowment contract and did not intend it, then he is not permitted to benefit from the well's water except for that for which it was endowed.
