Is expiation (kaffarah) and blood money (diyah) obligatory for the father who sent his son, not yet sixteen years old, to work in a construction workshop, or for the workshop owner who employed him in violation of the law, or is nothing due from either of them after his death resulting from a fall during work?

If the aforementioned young man is an adult, no sin or responsibility falls upon his father or the workshop owner. Adulthood is reached at the completion of 15 years, or by the growth of coarse hair around the pubic area, or by the emission of semen. The hadith of the Prophet, peace and blessings be upon him, states: "The well is a waste, and the mine is a waste," indicating that what is damaged in such cases is considered wasted and is not guaranteed. Referring to an adult young man as a child is incorrect, and laws that prevent him from working on the pretext that he is a child are unjust. Young men of his age used to engage in battles and lead armies in the past.
