Must a wife seek divorce from her husband who smokes, is quick to speak ill of people, sometimes neglects congregational prayers in the mosque, and talks excessively, despite him praying and fasting? And would she be sinful if she left him?
The husband prays and fasts, but he has four issues: smoking, which is forbidden due to its harm; excessive blameworthy talk that hardens the heart and makes its speaker disliked; hastiness in speaking about people, which leads to backbiting and slander; and sometimes being lax about praying in the mosque without an excuse.
The wife is advised to give her husband a chance to abandon these matters if he accepts the advice; otherwise, she has the right to request a divorce before consummating the marriage, as living with this type of person is harmful.
This is a trial from Allah, and it was obligatory to inquire about the husband before marriage and accept him based on his religiosity and character.
If the wife finds seriousness and sincerity in his desire to change, she should give him the opportunity.
It is advised to make supplication (Du'a), seek guidance through Istikhara, consult others, obey Allah, and maintain the prayers.
