Is it permissible to seek divorce from a miserly husband who does not fulfill his religious duties, exploits financially, and abuses his wife and son, which has affected their psychological and physical health, and who does not bear any responsibility?

If the husband falls short in providing the obligatory maintenance, deprives his wife of her rights, and humiliates her, then she has the right to seek divorce or to take her case to the Sharia judge to compel him to fulfill her rights or to grant a divorce. Al-Dardir mentioned the permissibility of divorce due to harm, such as abandonment, striking, and insults without a valid شرعي (religious) reason. Nevertheless, it is advised not to rush into seeking divorce but rather to attempt reconciliation, as preserving the marital bond holds great benefits for both spouses and their children. It is permissible for the wife to take from her miserly husband's money what suffices her and her child according to what is customary and reasonable, even without his knowledge, based on the hadith of Hind: "Take what suffices you and your child according to what is customary and reasonable."
