The validity of a divorce does not require the wife's consent or knowledge, nor does it necessitate its pronouncement before a marriage officiant (ma'dhun). However, the divorced wife's rights are not forfeited except with her consent. If the husband pronounces divorce before the wife relinquishes any of her rights, then the rights of a divorced woman become obligatory for her, and whatever occurs thereafter before the marriage officiant is not legally binding upon her. Disputed matters are to be referred to the Sharia court for resolution.
