How can a woman seek divorce from her husband who abuses her psychologically and physically, causing her to flee their marital bed, making her unable to bear living with him, and leading to a deterioration of her health?
The wife is advised to be patient with her husband's ill-treatment and to respond to it with kindness, to avoid what angers him, to seek the help of those who influence him, and to show him joy. If these matters do not work and the husband insists on his bad character, then there is no legal impediment to seeking divorce or khul'. As for the wife's apparent acceptance of the request for marital relations while inwardly displeased, there is no sin in it, as long as she fulfills her marital rights. Repentance is obligatory for refusing to share the marital bed, due to the Prophet's (peace and blessings be upon him) saying: "If a man invites his wife to his bed and she refuses, and he spends the night angry with her, the angels curse her until morning."
