Is it permissible for a mother to distribute a sum of money among her sons and daughters, and how should the distribution be carried out?
If the distribution of wealth among children is in the form of a gift, then it is permissible under four conditions: that the distributor be legally competent to dispose of property, that the distribution occur while the distributor is in good health (not during a death illness), that the recipients take possession of their share during the giver's lifetime and good health, and that the giver be just among his children in the distribution, unless there is a legitimate شرعي justification. The stronger opinion is to equalize between male and female in giving, even though some scholars believe in giving the male the equivalent of the share of two females. However, if the distribution is in the form of inheritance division, it is void, because a living person cannot be inherited from.
