Is it permissible for a person afflicted with constant سلس ( سلس البول - urinary incontinence / سلس الغائط - fecal incontinence ) who experiences the discharge of a viscous substance after defecation or when withholding it, which does not stop with washing, to adopt the Maliki concession regarding the pardon for impurities that affect the clothes and body, even if the سلس occurs on some days and not on others, or occurs every day and a half, or occurs sometimes and disappears at other times? Is inability to seek treatment a condition, even if treatment is possible but the afflicted person is ashamed to visit a doctor? And is it permissible to combine more than one madhhab (school of thought) to alleviate hardship?
A distinction must be made between a person suffering from incontinence (sahib al-salas) and a person with recurring ritual impurity (sahib al-hadath al-mustankah). The first pertains to ritual purity from minor impurity (taharat al-hadath), while the second relates to purity from filth (taharat al-khabath). The Malikis permit the person with recurring ritual impurity not to wash off the impurity if the impurity accompanies him daily, even if only once, and he is unable to seek treatment. This concession does not apply to someone whose impurity comes one day and goes another, or who refuses treatment, because shyness is not a valid legal excuse for refusing treatment. Furthermore, it is not permissible to combine different madhhabs (talfiq).
