The question

What is the ruling on a husband and wife remaining together in the same house without cohabitation, due to the husband's belief that his wife has become unlawful to him, despite numerous jurists issuing fatwas that the divorce did not occur because it was pronounced during a state of extreme anger?

The answer

If the husband utters the divorce pronouncement while in a state of anger where he does not comprehend what he is saying, then his divorce does not take effect. However, if he comprehends what he is saying, then the divorce does take effect. And if he utters "You are divorced" and "You are divorced, divorced, divorced" three times at the same moment, then this is considered three divorces according to the majority of scholars, and a major separation (baynunah kubra) occurs as a result. The woman does not become lawful for her husband again until she marries another husband and he consummates the marriage with her. Her second marriage must not be with the intention of making her lawful (for her previous husband).
