Is it permissible to judge a deceased person who died in a state of intoxication by saying that their destination is the Fire, taking into consideration their righteousness and good deeds, and will that intercede for them on the Day of Resurrection?

The answer

There are multiple narrations warning against a wine drinker if he dies without repenting, including the hadith: "Whoever drinks wine in this world, and does not repent from it, will be deprived of it in the Hereafter and will not be given to drink of it." Nevertheless, it cannot be definitively asserted that whoever dies while drinking wine, or committing any sin – as long as he does not deem it permissible – is an inhabitant of Hellfire. It has been narrated from Abu Hanifa that he said: "We do not testify concerning a specific individual that Allah will not forgive him, nor have mercy on him, nor that He will make him abide eternally in Hellfire."

Abu Dawud narrated a hadith about a man from the Children of Israel who judged another by denying him forgiveness, so his destiny was Hellfire, while Allah forgave the sinner.

Ibn Taymiyyah mentioned that sins do not absolutely necessitate entering Hellfire unless the preventing factors are absent, such as repentance, seeking forgiveness, expiating good deeds, atoning calamities, intercession, the prayers of believers, what is gifted to the deceased, the trial of the grave, and the horrors of the Day of Judgment.

The Prophet, peace and blessings be upon him, forbade cursing a man who was being flogged for drinking, saying: "Do not curse him, for by Allah, I know nothing but that he loves Allah and His Messenger."

Therefore, it is not correct to rule that whoever dies while drinking wine is an inhabitant of Hellfire. Rather, it is hoped that Allah will raise him by his good deeds and the two Shahadas, and forgive him.
