Is the wife considered an infidel in her husband's eyes if she neglects a single prayer until its time has elapsed without a valid excuse, based on the difference in jurisprudential tradition between them regarding the excommunication (takfir) of one who abandons prayer?

Following the opinion of those who consider the ترك الصلاة (abandonment of prayer) to be kufr (disbelief) makes a husband more diligent in advising his wife regarding her prayers. However, it does not entail the rulings of apostasy, such as the annulment of marriage, prevention of inheritance, or the abandonment of washing, praying over, and burying the person in Muslim cemeteries. This is because none of the Imams have held such a view. If the one who abandons prayer were a kafir (disbeliever), they would neither inherit nor be inherited from. The scholars are unanimous that the one who abandons prayer is disobedient but not a kafir, and Muslims have unanimously agreed on the inheritance of the one who abandons prayer and their burial in Muslim cemeteries, and that the one who abandons prayer must make up for the missed prayers.

Sheikh al-Islam Ibn Taymiyyah was asked about praying over a deceased person who did not pray. He replied that whoever outwardly declares Islam has the outward rulings of Islam applied to them, concerning marriage, inheritance, washing, praying over, and burial in Muslim cemeteries. Hypocrites who conceal their hypocrisy are subject to the rulings of Islam. Hypocrites during the time of the Messenger of Allah (peace be upon him) were prayed over and washed, and the rulings of Islam were applied to them. Ibn Taymiyyah mentioned that many people do not regularly observe the five daily prayers but do not abandon them altogether. These individuals possess both faith and hypocrisy, and the outward rulings of Islam apply to them regarding inheritance and other matters.

Muhammad ibn Nasr al-Marwazi mentioned in "Ta'zim Qadr al-Salah" that Ibn al-Mubarak was asked about the one who abandons prayer: "Do they inherit from each other if one dies, or if he divorces her, does her divorce take effect?" He replied: "As for analogy, there is neither divorce nor inheritance. But I am too timid."
