The prohibited bribery is that which is offered to invalidate a right, to establish a falsehood, or to attain something to which one has no right. However, that which is offered to attain a right or to ward off injustice or harm from oneself is permissible according to the majority of scholars. The sin in such cases falls upon the receiver, not the giver. Therefore, if the questioner finds no way to access his money except by giving a portion of it to the employee, there is no sin upon him, and the sin falls upon the employee alone.
