Does it count as a divorce if the husband swore to his wife, saying: "If you don't end the dispute between us, it will be the last day between you and me," and the dispute did not end, knowing that his intention was not divorce but rather a threat?

The husband's statement: "This will be the last day between me and you" is one of the ambiguous divorce pronouncements (kinayat al-talaq). Divorce does not occur with it unless the husband intended it. Since he did not intend it, the divorce has not taken place. The criterion for an ambiguous pronouncement is every word that has a close indication of separation and has not been commonly used for it, neither Islamically nor customarily. The spouses must be keen to avoid disagreements and resolve them with wisdom, and stay away from anything that leads to separation in order to maintain family cohesion.
