It is not permissible for a woman to abort the fetus, even if the crime of fornication does not justify the crime of abortion. The woman is entitled to the dowry as soon as the marriage is consummated, even if she confesses to fornication. However, the husband may pressure her to relinquish her dowry, based on the Almighty's saying: "And do not constrain them to take away part of what you gave them, unless they commit a clear immorality." Divorcing an adulterous woman depends on her situation: if she repents sincerely, she may be kept and assisted; otherwise, she must be divorced. If she is pregnant, and there is a possibility that the child is from the husband, then the child is attributed to him. But if there is no possibility other than that the child is from fornication, then the husband must perform li'an (oath of condemnation) with his wife to deny paternity of the child. The child is not disavowed except through li'an; otherwise, the child is attributed to the husband by virtue of the marriage bed. The husband's affliction by his wife's fornication does not mean that he himself was committing immoral acts. The husband should reflect on the extent of his shortcomings in his wife's upbringing and guidance.
