Is it permissible for a woman to seek khul' or divorce from her husband who does not pray, curses the Divine Being when angry, does not provide for her, repeatedly threatens her with divorce, beats her and her children, and mistreats his mother, especially since her heart has become attached to another man of religion and good character? And is it permissible for her to supplicate for her husband's destruction?

A husband's cursing of the Divine Essence is an act of disbelief (kufr) that necessitates the dissolution of the marriage contract (nikah (definition)). His case should be brought before a Sharia (definition) court so that he may be called to repentance. If he repents, then well and good; otherwise, they should be separated. Anger does not negate accountability unless it leads to unconsciousness. His immorality (fisq) due to abandoning prayers and his cursing justify and make it commendable to separate from him. If a divorce or khul' takes place, it is permissible for her to marry another man. It is permissible to supplicate against him within limits, but forgiveness is better.
