What are a wife's rights if she seeks divorce after discovering an inappropriate conversation between her husband and another woman, and her claim that she is living with him against her will, and is she entitled to demand everything she spent during their marriage?
If the husband repents from the unlawful conversation, it is not permissible for the wife to taunt him with it, because "one who repents from a sin is like one who has no sin." If the wife spends her money on the house with her consent, she has no right to demand it back. However, if she spends with the intention of getting it back, then she must take an oath and she has the right to demand it back. The husband must stop smoking. If the wife requests a divorce without harm, he is not obligated to answer her, and he may refuse until she compensates him with money for the khul'. Both spouses must treat each other with kindness. It is not permissible for the wife to leave her husband's house without his permission, however, it is desirable for him to permit her to visit her family for a customary period, as long as he does not fear that they will corrupt her.
