The question

What is the ruling on benefiting from the health insurance provided by Bupa Insurance Company for the treatment of the questioner and his parents? Is it permissible to insure cars in a country that mandates it? What is the validity of the fatwa of one who permitted insurance if the company does not deduct anything from the employee's salary? What should the questioner do if he is surprised by the continuation of his insurance subscription despite his request to cancel it?

The answer

If an employee is entitled to health insurance from their company, and the company has arranged this insurance with a commercial insurance company, then the employee is permitted to benefit from it because they are receiving their right from the company. However, if the insurance is optional, then it is either cooperative (takaful) insurance, which is permissible and even encouraged, because compensation is made from the premiums paid by the employees to one another, and the company's role is that of an agent. Or it is commercial insurance, which is impermissible due to its inclusion of gharar (excessive uncertainty) and maysir (gambling), as the company pays for treatment costs in exchange for premiums. It is not permissible to subscribe to it optionally, but for compulsory insurance, the sin is on the one who enforced it.
