What is the ruling on not spending the night in Mina during the Days of Tashreeq, and is a blood sacrifice (fidyah of damm) obligatory, and if it is obligatory, is it the slaughter of a sheep for each night, or is one sufficient?

Staying overnight in Mina on the nights of Tashreeq is obligatory according to the majority of jurists, and whoever leaves it without an excuse must offer a sacrifice (dam). The obligatory amount for staying overnight is to remain for most of the night.

Leaving the overnight stay has two situations: 1. If it is due to an excuse: There is nothing upon him, based on the Almighty's saying: (So fear Allah as much as you are able). This includes illness, lack of space, or being among the shepherds and water-providers. 2. If it is without an excuse: Then he must offer a sacrifice (dam), based on the saying of Ibn Abbas (may Allah be pleased with both of them): "Whoever leaves a ritual or forgets it, let him spill blood (offer a sacrifice)." One sacrifice is sufficient for leaving the overnight stay on the days of Tashreeq. He should slaughter it and distribute it among the poor in the Sacred Precinct, and he should not eat from it.
