What is the ruling on someone who hastened to depart Mina on the second day of Tashreeq, but the sun set on them before they could exit due to congestion, and is a sacrifice (dam) incumbent upon them for that? If so, when and where should the sacrificial animal (hady) be slaughtered?

If the one who departs early throws before sunset and then is delayed from Mina due to crowds or being occupied with travel matters, there is nothing upon him, as mentioned by An-Nawawi. However, if the throwing was after sunset, or if the delay was for an excuse other than crowds or being occupied with travel matters, then he must spend the night and throw on the following day. The blood sacrifice (dam) for neglecting this is not conditioned to be during the sacred months.
