What is incumbent upon us (my father, mother, and me) due to not performing the Rami (stone throwing) on the Days of Tashreeq and not spending the entire nights of Tashreeq in Mina?
Regarding the father, if he has not completed the circumambulation of Ifadah (Tawaf al-Ifadah), he is still in a state of ihram, and he must return to Makkah to complete the rites. He must refrain from relations with women. What he did of prohibited acts out of ignorance incurs no penalty.
Regarding the mother and daughter, stoning (rami) was obligatory for them because they were able to stone and search for the father. For leaving the stoning, each of them owes a dam (a sheep) to be slaughtered and distributed among the poor of the Haram. As for the shaykh who ruled that fasting for ten days is obligatory, he makes it obligatory only when one is unable to sacrifice the hady (sacrificial animal). As for staying overnight in Mina, the mother and daughter are not liable for anything for not staying overnight on the second and third days of Tashriq due to searching for the father; they are excused. As for the father, if he appointed someone to stone on his behalf and he was unable to stone, there is no penalty on him. However, if the pebbles were not thrown on his behalf, or he was able to and fell short, he owes a dam. If he stayed overnight in Mina on the eleventh and twelfth nights and departed early on the second day, there is no penalty on him.
