What is the ruling on pilgrims judging me in the matter of the "foolish woman," and what is the matter of the "foolish woman"?
It is not known that Al-Hajjaj adopted the opinion of Ali ibn Abi Talib in the "Kharka'a" issue. Rather, it is known that he adopted the opinion of Uthman ibn Affan, may Allah be pleased with them both. The "Kharka'a" issue is one where a person dies, leaving behind a mother, a grandfather, and a sister. It was named so due to the extensive disagreement among the Companions regarding it, and seven opinions have been stated concerning it:
1. The opinion of Abu Bakr and those who agreed with him: The mother gets one-third, and the remainder goes to the grandfather. 2. The opinion of Zayd and those who agreed with him: The mother gets one-third, and the remainder is divided between the sister and the grandfather. 3. The opinion of Ali: The sister gets one-half, the mother gets one-third, and the grandfather gets one-sixth. 4. The opinion of Umar and Abdullah: The sister gets one-half, the mother gets one-third of the remainder, and the rest goes to the grandfather. 5. The opinion of Ibn Mas'ud: The mother gets one-sixth, and the remainder goes to the grandfather. 6. Another opinion of Ibn Mas'ud: The sister gets one-half, and the remainder is equally divided between the grandfather and the mother. 7. The opinion of Uthman: The estate is divided into three equal parts among them, with each receiving one-third.
Al-Hajjaj asked Al-Sha'bi about it, and he informed him of the disagreement among five of the Companions: Uthman, Ali, Ibn Mas'ud, Zayd, and Ibn Abbas.
