What is the ruling on my saying, "Ask the Messenger of Allah" to someone who inquired about the reason for differentiating between male and female in the 'Aqiqah, and is that considered a lack of respect towards the Prophet, may Allah's prayers and peace be upon him?
We do not see in this any disrespect towards the Messenger of Allah, peace and blessings be upon him, but one should accustom oneself to saying "I do not know" regarding what one does not know the answer to, and to be gentle with those who ask questions. It would have been more appropriate to suggest to him to ask scholars or to research in the commentaries on the Hadith. For the people of knowledge have mentioned that the distinction between male and female exists in Islamic law, and it is apparent in five matters: inheritance, manumission, testimony, blood money (Diyah), and 'Aqiqah, where the woman receives half of what the man receives in each of these matters.
