Is it permissible to follow the opinion of Imam Malik, who held that only making up the day (qada') is obligatory, without expiation (kaffarah), for one whose fast was broken by ejaculation due to thinking about a man she loved? And is this considered a deceptive following, or is it permissible to wait for winter to fast the two consecutive months if expiation is obligatory?

What appears to be the case is that what is discharged in this situation is most likely pre-seminal fluid (madhy). It is obligatory to distance oneself from such thoughts, especially during the daytime in Ramadan. If semen (maniy) is discharged, the Maliki school stipulates that whoever continues to ponder lustful thoughts while fasting until ejaculation occurs, must make up the fast (qada') and offer expiation (kaffarah). If one did not continue the thoughts, then only making up the fast is required. The expiation according to the Maliki school is a choice between feeding sixty poor people, or freeing a slave, or fasting for two consecutive months.
