Is it permissible to benefit from the profits of a project established with money acquired through unlawful means, while donating the unlawful principal to Muslim welfare, given the impossibility of returning the money to its rightful owners?

Money whose owner has despaired of finding should be disposed of by spending it on general Muslim welfare, or by giving it to the poor and needy. A poor person is permitted to take from it according to his need. Ibn Hajar al-Haytami mentioned that usurped money whose owner is unknown should be placed with a trustworthy judge. If hope of identifying its owner is lost, it then becomes part of the public treasury (Bayt al-Mal) and is spent on public welfare, such as mosques, or given as charity to the poor. A poor person who possesses this money is permitted to take from it according to his need, or to give it as charity to himself and his dependents if they are poor. If a person is poor and has the ability to start a profitable legitimate business, there is no harm in him taking from this money as capital for his project.
