If a person embraces Islam at my hands, who inherits from him if he dies and there is no Muslim in his family?

If a Muslim dies without an heir, his wealth devolves to the treasury of the Muslims (Bayt al-Mal).

Disbelieving relatives do not inherit from a Muslim, due to the Prophet's (peace and blessings be upon him) saying: "A Muslim does not inherit from a disbeliever, nor does a disbeliever inherit from a Muslim."

It is not permissible for someone claiming inheritance to take any of the wealth due to the absence of a legitimate cause for inheritance, unless he is poor, in which case he may take from it as other poor people do.

Some scholars have held the view that if a person embraced Islam at someone's hands and then died without an heir, that person inherits from him, citing the Marfu' Hadith of Tamim al-Dari: "He is the most entitled of people to his life and death." However, there is disagreement regarding the authenticity and implication of this hadith. There is no harm in adopting this view when there is no Bayt al-Mal for Muslims, or if it is not properly regulated, or if it cannot access the wealth.
